Today, May 7, 2025, is the last day of the deadline for compliance with the new Law on Occupational Safety and Health (“Official Gazette of RS”, No. 35/2023), which entered into force in 2023. Although employers had a two-year transition period, many obligations remained unfulfilled – which can have serious legal and financial consequences.
The law was adopted with the aim of raising the level of employee protection, introducing preventive measures and clearly regulating situations that were not precisely regulated until now, including work from home and remote work.
The most important obligations that must be fulfilled from today:
- Mandatory employee insurance for work-related injuries and occupational diseases
- Regular medical examinations, in accordance with the risk assessment
- Periodic trainings for safe and healthy work (annually or at least every three years)
- Internal procedures for issuing permits for high-risk jobs
- Act on risk assessment and for employees who work from home or remotely
- Professional personnel for OSH – licensed and with mandatory training
- Registration of the start of works and the preparation of studies for construction sites
Penalties for non-compliance:
Failure to comply with legal obligations from today can lead to serious fines:
For legal entities: from 1,000,000 to 1,500,000 dinars
For entrepreneurs: from 200,000 to 400,000 dinars
For responsible natural persons: from 30,000 to 150,000 dinars
Among other things, labor inspectors will have new powers, including the possibility of temporarily prohibiting work if safety conditions are not met, especially at construction sites and jobs with increased risk.
